We are the controller (Verantwortlicher) for the personal data processed on this site under Art. 4(7) GDPR. For any privacy question or to exercise your rights, contact jakob@aruba-forever.com.
Data you give us through forms: name, email, phone, country, property preferences (quiz answers) and, for agents, agency details. Data collected automatically when you visit: IP address, device and browser type, referring page, pages viewed and timestamps, through server logs and, only with your consent, analytics. We do not knowingly collect data from anyone under 16 and do not ask for special-category data.
To answer your requests and introduce you to one partner agent per segment: the service you ask for when you submit the quiz or a form (Art. 6(1)(b) GDPR, pre-contractual/contractual). To send the booklet and, where you opt in, updates (Art. 6(1)(a), consent). To secure, run and improve the site and prevent abuse (Art. 6(1)(f), our legitimate interest). To meet legal, tax and accounting obligations (Art. 6(1)(c)). Providing form data is voluntary, but without the fields marked required we cannot process your enquiry.
Buyer enquiries are forwarded to exactly one partner agent, the one responsible for your segment, so they can contact you about your search. We also use processors acting on our instructions under Art. 28 GDPR data-processing agreements: our website host and form provider (Vercel Inc. and Google Ireland Ltd.). We do not sell your personal data.
We set only strictly necessary cookies to run the site, which need no consent. We do not use analytics or tracking cookies, and there is no cookie banner because nothing here requires your consent. If we ever add analytics, we will ask first and update this notice before switching anything on.
Our audience includes visitors from the United States, Canada and elsewhere, and some providers (e.g. Google) may process data on servers outside the European Economic Area. Where that happens we rely on an EU adequacy decision or on the EU Standard Contractual Clauses together with additional safeguards. A copy of the relevant safeguards is available on request.
We keep personal data only as long as needed for the purposes above. Enquiry and lead records are retained for the duration of the partner protection window and then for the statutory retention periods that apply to us (generally up to 6–10 years under German commercial and tax law), after which they are deleted or anonymised.
You have the right to access, rectification, erasure, restriction, data portability and objection, and to withdraw consent at any time without affecting prior processing, write to jakob@aruba-forever.com. You may also lodge a complaint with a supervisory authority; ours is the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit). We do not use your data for automated decision-making or profiling that produces legal effects.
If you are a California resident, you have the right to know what personal information we collect and why, to request deletion, to correct it, and to opt out of any "sale" or "sharing" of personal information. We do not sell your personal information for money. To exercise these rights, contact jakob@aruba-forever.com; we will not discriminate against you for doing so.
We may update this notice as the service or the law changes. The current version, with its date, always applies and is published on this page.
Aruba Forever is an independent information and buyer-introduction service for property buyers on Aruba, operated by Hype Studio UG (haftungsbeschränkt), Berlin ("we"). We are not a licensed real-estate brokerage, not a law firm, and not a tax or financial adviser. We publish guides and, on request, introduce you to a local professional. Where we agree a separate, paid advisory engagement with you in writing, that written agreement governs the advisory service in addition to these terms.
Guides, articles, the booklet and quiz results are general information, not legal, tax, immigration or investment advice, and are provided "as is" without warranty of accuracy or completeness. Figures such as taxes, fees, lease terms and prices change and vary by property: verify everything with a qualified notary, lawyer or adviser before you commit. We do not warrant that any introduction will lead to a viewing, an offer or a purchase.
When you submit the quiz or a contact form, you ask us to introduce you to one partner agent for your segment. The property search, negotiation, contract and closing are conducted by that independent, locally licensed Aruban professional (and the notary and seller) under Aruban law. We are not a party to that transaction, hold no client funds, and are not responsible for the acts, omissions, advice or licensing of any agent, notary or seller.
Using the website and the standard buyer introduction is free of charge for buyers. We may receive a referral commission or success fee from a partner agent when an introduction leads to a transaction: this never increases the price you pay. A separate service or advisory fee is only ever owed by you if we have agreed it with you expressly and in writing beforehand. Any fees payable to an agent, notary or authority are governed by their own agreements, not by us.
The booklet account stores your download and saved listings. You must provide accurate information, keep your password confidential and are responsible for activity under your account. We may suspend or close accounts that are misused, provide false information or breach these terms.
Our relationship with agents is governed by a separate partner agreement (segment exclusivity, referral fee, lead registration and an 18-month protection window). These terms do not replace that agreement and create no rights for buyers under it.
You may not misuse the site, submit false or third-party data without permission, scrape it, or attempt to disrupt it. All content on this site (text, guides, photography, illustrations and design) belongs to us or our licensors and may not be copied or reused without our written permission.
We aim to keep the site available but do not guarantee uninterrupted or error-free operation and may change, suspend or discontinue features at any time.
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For simple negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance possible and on which you may rely), and then limited to the foreseeable, contract-typical damage. Any further liability is excluded. Liability under the German Product Liability Act remains unaffected. Because introductions and information are provided free of charge, we accept no liability for decisions you make in the property transaction itself.
We may update these terms; the version in force when you use the site applies, and material changes will be posted here. If any provision is or becomes invalid, the remaining provisions stay in effect.
These terms and your use of the website and our introduction service are governed by German law, with Berlin as the place of jurisdiction where the law permits. Any property purchase on Aruba is governed by Aruban law and by the agreements you enter into with the agent, notary and seller there. If you are a consumer, the mandatory consumer-protection rules of your country of residence remain unaffected.
